About Torrens system and customary land

Dear Editor,

Re: P.M. slams bush lawyers

And how did the Prime Minister know so much about the Land Registration Act?”

“I have been thoroughly briefed by the Attorney General,” he said.

I have to take my hat off to them bush lawyers for having such foresight in wisdom and intelligence to see the flaw in the flaws in this Land Registration. The man who pushed and signed the Customary Land Registration Act blindly had to be explained to him what this legislation was about by the Attorney General.

And all the while the Bush lawyers have been pointing out to him and everyone else what his blindly pushed Act was all about. Now finally came out and admitted what the Bush Lawyers had been saying. Torrens System!

“Prime Minister Tuilaepa Dr. Sa’ilele Malielgaoi has reminded that the

Torrens Land System is embedded in Samoa via the Land Registration Act 2008.”

“In doing so, he insists that the Torren’s Land System “has no legal effect on customary land ownership, as it applies only to free hold land.”

So what reason for the Customary Land Registration Act if the Torrens System apply only to Freehold lands?

“b) Permit or deem ownership in any customary land to vest in a person otherwise than as determined under any law dealing with the

determination of title to customary land.”

I wonder how many laws that will be amend to allow alienation of customary land under this any law statement. (otherwise than as determined under any law dealing with the determination of title to customary land.”)
