The company leasing the Returned Services Association (R.S.A) building is facing a lawsuit from the Returned Services Association of Western Samoa Incorporated. 

R.S.A. Inc. is taking the Tatiana Investment Company Limited to Court claiming its lease is overdue and owes the Association more than $80,000. 

However, a counter claim from Tatiana Limited claims the R.S.A. Inc. owes the company $240,000 for upgrading the building. 

The matter was called in the Supreme Court on Monday. 

Leota Raymond Schuster is representing the Tatiana Company. 

Travis Lamb is the lawyer for R.S.A. Inc. 

Justice Vui Clarence Nelson presided.

Mr. Lamb told the Court he had served application on statutory demand last Thursday and statement of defense on counter claim. 

He argued that the respondent had filed an application to set aside the statutory demand out of time in terms of Companies Act. 

However, Leota argued that time was not an issue and deny any liability. 

Justice Vui reminded Leota that if it’s not an issue he needs to provide valid grounds and document to substantiate his argument. 

Justice Vui then adjourned the matter until 5th December for respondent hear the preliminary issues. 

After cyclone Ofa and Val in 1990 the Tatiana company took over the R.S.A. building and turned it into a night club that is now known as R.S.A.
