Father, daughter in sex hearing wanted

A warrant of arrest has been issued by the Supreme Court for a father and daughter who have already pleaded guilty to a charge of incest.

The warrant was issued by Justice Lei'ataualesa Darryl Clarke after the pair failed to appear in Court for sentencing.

When the matter was called, the man and his daughter, whose identities are suppressed, were nowhere to be seen.

Justice Leiataualesa then immediately issued a warrant of arrest.

A suppression order was issued on the names and details of the father and daughter who are from Savai’i. 

This case was initially mentioned in the Supreme Court as incest case of a brother and sister. 

However the Court was informed that the defendants were in fact a father and his biological daughter.

As reported earlier, the Court heard from the father that they have been banned from their village in Savai’i and at the time they were in custody and were released on bail. 

They were ordered to reside at Vaivase-uta and surrender all their travel documents. 

They were also told to sign in at the Apia Police Station as part of their bail conditions. 

The daughter, she was ordered to sign in at the Apia Police Station every Tuesdays and Thursdays before midday.

Her father was ordered to sign in every Mondays and Wednesdays.

Chief Justice, His Honour Patu Tiava’asu’e Falefatu Sapolu, at the time also told them to live separately.

 “I know you will both reside at Vaivase-uta, but you must live separately from each other,” he told the defendants.

“You must not stay together otherwise the Police will detain you again and you will be held in custody until the Court comes up with a decision.”
